By using this website or any sub-site accessible on this website, the user (“user” or “you”) accepts, without limitation or qualification, the Terms and Conditions set out below and any additional Terms and Conditions set out in any sub-site. If you do not agree to these Terms and Conditions, you should exit the website.
You will need to register with Home Grown Africa to place an order for products through this website.
In return for allowing you to use the Home Grown Africa website and benefiting from our services, you agree that any information you provide us about yourself at any time will be true, accurate, current and complete and that you will ensure that this information is kept accurate and up to date. If incorrect information is supplied, any contractual obligation Home Grown Africa has is immediately null and void.
All goods displayed on our website are subject to availability. If any goods you ordered are not immediately available or are not available at all, we will let you know as soon as possible. Goods are only available for delivery to within 60kms of Cape Town.
The stated prices on our website are in South African Rand and are only valid and effective in South Africa.
We will use our best efforts to accurately display the goods, specifically regarding their colour, description and price. Please remember however that the way you see the goods is also dependent on the device that you are using to access our websites or apps. We cannot guarantee that the goods you receive will look exactly as you have seen it.
Unless otherwise agreed in writing signed by an officer of Home Grown Africa, all delivery dates are estimates and Home Grown Africa shall use its reasonable efforts to deliver all orders within the time specified; however, in no case shall Home Grown Africa be liable for any expense, loss or damage whatsoever suffered by you as a result of the Home Grown Africa’s failure to deliver your order by the specified date. Customers agree to allow a maximum of 30 days for delivery from the date of ordering, and in the case of undelivered goods, refunds will only be issued after 40 working days (from the date of order).

Home Grown Africa has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Home Grown Africa shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Warranty and Disclaimer
Home Grown Africa warrants that the purchased Product is free from defects in materials and workmanship at the time of delivery. If an analysis is stated on the face of the Invoice, it is not intended to be a complete analysis and is not to be regarded as a specification or warranty, unless specifically stated in writing to be such. Images are for illustration purposes only, and products may differ to that of the image shown.
Your right of cancellation
You may cancel the contract by notifying us no later than 7 working days after we deliver the goods that you are cancelling the contract. We strongly recommend that you do this by using our online contact form.
- If you cancel the contract you must take reasonable care of the goods from the time you receive them until you return them to us.
- If you cancel the contract you must return the goods to us at your own expense.
- If you cancel the contract and do not return the goods as required, we may charge you our direct costs of recovering the goods.
- If you cancel the contract/order either before the order has been dispatched or once you have received the goods a 25% re-stocking fee will apply.
Home Grown Africa will accept responsibility for any faulty or incorrect products that we ship, including incorrect sizes. We will replace these items free of charge, or refund if preferred, on receipt of the returned goods. Home Grown Africa will cover the return delivery fee of incorrectly shipped goods up to the value of ZAR1000. We will not accept the return of goods returned without tags or original packaging.
Please inform us of your intention to return within 7 days of receipt. For your protection, Home Grown Africa recommends that you use a recorded delivery service as we cannot be held responsible for goods not received.
To facilitate the processing of your order, please include a note with your order number to allow us to easily identify the return. Please allow up to 14 working days for your refund to be processed after receiving the goods.
Limitation of liability
To the fullest extent permitted by applicable laws, neither Home Grown Africa nor any of their respective directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with the use of, or inability to use, the materials in and/or facilities or services offered through this website, including, but not limited to, indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, even if Home Grown Africa has been advised of the possibility of such loss or damages or such loss or damages were reasonably foreseeable. If this clause is unenforceable in whole or in part in any jurisdiction due to relevant laws, then in no event shall Home Grown Africa total liability to you for all damages, losses, and claims (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing this website.
Acceptance of Orders
Your order is accepted and an invoice is created when we take payment for the goods you have ordered and not before. For instance, an invoice is created at the point when we take payment for the goods you have ordered. Until the goods are despatched we may reject, and you may cancel, the order.
Exceptions apply to orders for personalised items and goods made to your order which, in most cases, cannot be cancelled by you once you have received email confirmation of your order. Following formation of the contract, we shall continue to own any goods ordered until we have received payment in full from you even though the goods may have already been delivered to you.
Any goods supplied will conform to the contract.
